Bill Kresnak; Government Affairs Editor with the American Motorcyclist Magazine contacted me last week by telephone wanting information about Amanda and her Injuries and Insurance Woes.....
He emailed today with the following;
Hello Mona,
Thanks for the update. Unfortunately, such exclusions (racing, practicing for a race) are pretty common in many insurance policies. Some employer-provided insurance policies won’t even pay for the treatment of injuries suffered in a street motorcycle crash, and we’re fighting that in Congress. (See below)
As an AMA member, I know Amanda gets our magazine. The story about Amanda will appear in the July issue, which Amanda should get by June 10.
If I come up with anything that may help you I’ll let you know. I know it’s very frustrating and things look pretty grim, but things will work out.
I realize there are people that question some of the rules or ideas AMA have, but this one should hit all of us that own or ride a motorcycle, quad or any other "off-Road Vehicle". More and more Health Insurance Companies are finding ways by printing a "Generic Exemption List" that they can tweak to fit their needs in order to DENY any and all claims made if you get Injured while riding, racing, conditioning, training or anything else they can think of. One of their newest "exemptions" is that if you are compensated in any way either; cash, discounts, sponsors or any thing else they can put you with, you don't even have to be Pro or Semi-Pro just Joe-Blow this is considered "compensation". Therefore they do not have to pay a thing, it doesn't make a difference if you are trail riding, conditioning, training, running to get into shape, etc.... They will find your name in a News Paper, or Race Score Sheet and it doesn't matter if your name shows up the day you got hurt or 4 years earlier.... If you have raced in the past, you in there eyes are "training or conditioning" and that is not covered. So more or less, if you have ever had your name on a Race Entry List, Score Sheet or News Paper or Magazine, you are either racing or training and of course that is not covered.
If we don't write to our Governmental Officials; we will continue seeing the Health Insurance Companies pad their wallets while the Consumer gets stuck in the you know what......
Please notify your State and Governmental Official to Co-Sponsor and Support S. 616, "The HIPAA Recreational Injury Technical Correction Act."
If you need a generic letter, let me know and I will post one.... If you need Governmental and State Officials email addresses, I will post them...... Just let me know....
